The owner of TeamTaylorMade.com web site, Timothy P Taylor, was ordered to pay back the profits he made from the venture. His web site tricked visitors into installing spyware and adware onto their machines in the guise of free videos and free screen savers. Taylor will be returning $4595.36 USD, a paltry sum compared other recent legal news, like the sentencing of two software pirates.
Taylor’s download files were infected with the Media Motor spyware engine made by ERG Ventures. When a customer downloaded what they thought were free videos and free screen savers, they were inviting this spyware and ad ware onto their machines unknowingly. It is a common means of transport for viruses as well as spyware; however, Taylor is only accused of invasion, not destruction.
ERG Ventures, creators of the spyware, were made to pay a much stiffer fine in the Nevada court. Costing the perpetrators of the nefarious program over $330,000, 73 times more than Taylor’s $4595 USD, in accordance with the terms of the United States Federal Trade Commission lawsuit against the company.
It is hoped that by cracking down on companies that practice these underhanded tactics it will help curb the rampant invasion of spyware and ad ware trojans around the world. Spyware is found to be a problem on machines everywhere. Often the user is blamed, and rightly so, for opening that email attachment from an unfamiliar party or otherwise participating in the installation.
